Committee Approves Payroll Policy Amendment

Oneida, TN (2011-09-06) The Emergency Services Committee of the Scott County Commission approved a amendment to its payroll policy Tuesday night, a move designed to simplify accounting at the Sheriff’s Department.

Scott County Sheriff Mike Cross, along with County Attorney John Beaty and Finance Director Carol Lowe, outlined a plan to amend the process by which overtime is calculated within the Sheriff’s Department.

Currently, under the Tour of Duty section of the Fair Labor and Standards Act (FLSA), employees of the Sheriff’s Department have their overtime calculated on a 28-day schedule. Once an employee has worked 171 hours in those four weeks, all additional time is accrued at a time-and-a-half rate, and added to the employee’s compensation time bank. As amended, the calculation will now be done over a 14-day schedule, with the maximum of 86 allowable hours over the period.

The amendment is expected to make the process of calculation by the Finance Department and employees greatly easier. “This is not a change in policy, this is merely a change in how we look at things,” said Beaty.

The Tour of Duty section of the FLSA allows employers of law enforcement personnel to work them more than 40 hours a week at regular pay.  In a 14-day period, the extension is capped at 86 hours, while the previous cap was 11 hours over the 28 days.

The Committee unanimously passed the change on to the full Commission, which will take up the matter at its regularly scheduled meeting on September 19, 2011.
