On February 10th, Oneida Police Officer Kevin Marlow received a call for service to investigate a male subject, identified as Brian Garrett, who was allegedly loitering outside Ace Hardware on Industrial Lane in Oneida. Ace Hardware was closed at the time. Upon arrival, Officer Marlow observed a male dressed in dark clothing walking up the embankment from the fence around the business. Garrett appeared to be very nervous as Officer Marlow approached him. Garrett was asked if he had any weapons or illegal contraband in his possession and he stated that he didn’t know before stating “no.” Officer Marlow asked him again and he stated that he had two needles in his right front pocket. Officer Marlow then asked Garrett for consent to search his person and consent was given. In his right front pocket two insulin needles were found along with a clear plastic baggy with less than 0.1 grams of a white crystalline substance. Garrett stated he found the baggy as he was walking along Industrial Lane. He was arrested and charged with Possession of a Schedule II Drug and two counts of Possession of Drug Paraphernalia.
